A importância do registro de marca para o empresário

Todo pequeno empresário abre o seu negócio com o sonho, o desejo de ver sua pequena empresa crescer. Para isso dedica muito dinheiro e tempo para fazer o negócio dar certo. Por isso, já no início do negócio é importante que o pequeno empreendedor esteja atento para que nenhum esforço seja em vão, bem como para que não tenha problemas no futuro que poderiam ter sido evitados.

A escolha da marca é um ponto muito importante no início de um empreendimento, ela identifica o negócio, o conecta com o público bem como o diferencia dos concorrentes.

A marca pode se apresentar de diferentes formas, pode ser nominativa, quando ela é um sinal formado apenas por palavras ou combinação de letras ou algarismos, sem apresentação de figuras ou símbolos. Pode ser uma marca figurativa, quando ela apresenta um desenho ou figura, popularmente conhecida como logotipo e não apresenta palavras ou combinação de letras. Ou ainda pode ser uma marca mista, quando ela combina elementos figurativos e palavras ou combinação de letras. Um outro tipo de marca é a marca tridimensional, que é o formato associado ao produto da empresa capaz de individualiza-los dos demais (por exemplo: o formato da garrafa do famoso refrigerante de cola).

Em setembro de 2021, o INPI publicou uma portaria regulamentando o resgitro de marcas de posição. Portando, estabeleceu uma nova forma de apresentação da marca. O órgão deve adaptar os sistemas para começar a admitir os pedidos de registros de marcas de posição no prazo de 90 dias. De acordo com a nota técnica do órgão, marca de posição é caracterizada por um sinal que sempre aparece no objeto (produto) da empresa em uma determinada posição fixa e mesmas proporções. Esse sinal garante distintividade aos produtos ou serviços da marca (por exemplo: sapato com solado vermelho).

Não é incomum ver uma empresa já consolidada ter que trocar a sua marca por conta de um registro prévio desta marca. Isso gera muito prejuízo ao empresário que após anos de dedicação para consolidar uma marca se vê impossibilitado de continuar usando, tem que fazer a troca e começar o trabalho do zero novamente. Daí a importância de se pensar no registro da marca logo no início do empreendimento.

Com o registro o empresário elimina a hipótese de ver sua marca sendo confundida perante os consumidores com a presença de outras marcas similares (por exemplo: uma marca similar com péssima reputação no mercado pode afetar a outra marca com boa reputação), confere uma boa reputação para a marca e impede que outro empreendimento comercialize produtos no mesmo segmento empresarial utilizando-se de marca igual ou semelhante. Fazer o registro da marca é uma decisão estratégica que o empresário deve tomar logo no início do seu empreendimento, isso vai definir a atuação empresarial demonstrando a seriedade do negócio e que a empresa pensa a longo prazo.

Uma marca forte com um empresário que sabe explorar todo o potencial da marca faz com que ela amplie os lucros em grande escala. O desejo de consumo cria consumidores que estão dispostos a pagarem mais caro por uma marca forte, e muitas vezes eles dão preferência à essas marcas.

Com o crescimento do negócio a marca registrada se torna um elemento de grande valor para o empresário, um ativo intangível com valor econômico independente de todo o restante do patrimônio da empresa. Existem marcas que somente o elemento marca possui mais valor do que os outros bens do negócio. Assim, a marca pode se tornar uma outra fonte de renda para a empresa, com a criação de franquia, licenciamento, cessão ou venda da marca para terceiros e etc. Tudo isso é possível graças à uma marca forte, que estará devidamente registrada e protegida.

Apesar de não ser obrigatório, o registro de marca é muito importante pois é a única forma de protegê-la contra uso indevido e outras empresas que queiram copiar a marca já estabelecida no mercado. O registro é feito no INPI – Instituto Nacional da Propriedade Industrial, ele é o órgão responsável por examinar e conceder os registros de marcas no Brasil. Com a concessão do registro pelo INPI a marca estará protegida em todo o território nacional por 10 anos, podendo o registro ser renovado. É preciso destacar que o registro feito na junta comercial não confere proteção a marca, ele serve para registrar a empresa, sendo necessário para inscrever a empresa no cadastro nacional de pessoa jurídica e conferir o CNPJ da empresa, mas não confere proteção.

When, while the lovely valley teems with vapor around me, and the meridian sun strikes the upper surface of the impenetrable foliage of my trees, and but a few stray gleams steal into the inner sanctuary, I throw myself down among the tall grass by the trickling stream; and, as I lie close to the earth, a thousand unknown plants are noticed by me: when I hear the buzz of the little world among the stalks, and grow familiar with the countless indescribable forms of the insects and flies, then I feel the presence of the Almighty, who formed us in his own image, and the breath of that universal love which bears and sustains us, as it floats around us in an eternity of bliss; and then, my friend, when darkness overspreads my eyes, and heaven and earth seem to dwell in my soul and absorb its power, like the form of a beloved mistress, then I often think with longing, Oh, would I could describe these conceptions, could impress upon paper all that is living so full and warm within me, that it might be the mirror of my soul, as my soul is the mirror of the infinite God!

O my friend — but it is too much for my strength — I sink under the weight of the splendor of these visions! A wonderful serenity has taken possession of my entire soul, like these sweet mornings of spring which I enjoy with my whole heart. I am alone, and feel the charm of existence in this spot, which was created for the bliss of souls like mine.

I am so happy, my dear friend, so absorbed in the exquisite sense of mere tranquil existence, that I neglect my talents. I should be incapable of drawing a single stroke at the present moment; and yet I feel that I never was a greater artist than now.
